Musfeld Aircotech determines the purposes for which and the means by which the personal data is processed. C. What data do we process and for what purposes?

In principle, we obtain and process the following data for the purposes listed below:

We process this data to implement, manage and process the contractual relationship, to provide and demand contractual services, in particular in connection with the planning and support of ventilation and air conditioning projects, to issue invoices and to communicate with you. This includes various aspects of our operational organization, such as resource planning, as well as corporate development, such as the acquisition and sale of company shares or companies.

D. Where does the data come from?

From you: You (or your end device) provide us with the majority of the data we process yourself (e.g. in connection with the initiation or conclusion of a contract, the use of our website, via the contact form on our website, or communication with us). E. To whom we disclose your data

  • Service providers: We work with service providers in Germany and abroad who process data that they have received from us or collected for us on our behalf (e.g. IT providers), in joint responsibility with us or on their own responsibility. F. Is your personal data also sent abroad?

We process and store personal data mainly in Switzerland and the European Economic Area (EEA), but potentially in any country in the world, depending on the case – for example via subcontractors of our service providers or in proceedings before foreign courts or authorities.

Gstatic is a background service used by Google to retrieve static content in order to reduce bandwidth usage and preload required catalog files. In particular, the service loads background data for Google Fonts and Google Maps.

I. How long do we store your personal data?

In principle, your personal data will be deleted as soon as it is no longer required to achieve the purpose for which it was collected, unless longer storage is necessary to fulfill legal obligations (e.g. storage and documentation obligations), contractual or pre-contractual obligations or our legitimate business interests (e.g. to assert, exercise or defend legal claims).

We store contract-related personal data for as long as the contractual relationship exists and thereafter for a further ten years after termination of the contractual relationship, unless a shorter or longer statutory retention obligation applies in individual cases, the retention is required for reasons of proof or for another valid reason under applicable law, or the deletion of the data is required earlier (e.g. because the data is no longer required or we have to delete the corresponding data). The personal data automatically transmitted by you through the use of our website for the purpose of displaying, operating and ensuring the functionality of the website will be deleted within three months.

We have implemented technical and organizational measures to maintain the security of personal data and to protect it against unauthorized or unlawful processing, unintentional loss, alteration, disclosure or access.

If the EU General Data Protection Regulation (“GDPR”) is applicable in exceptional cases for certain data processing, this section in para. L.

We base the processing of your personal data in particular on the fact that

  • them as in para. C. is necessary for the initiation and conclusion of contracts and their administration and enforcement (Art. 6 para. 1 lit. b GDPR);
  • it is necessary to protect our legitimate interests or those of third parties as described in para. C., namely for communication with you or third parties, to operate our website, to improve our electronic offerings, for security purposes, for compliance with Swiss law and internal regulations for our risk management and corporate governance and for other purposes such as training and education, administration, evidence and quality assurance, organization, implementation and follow-up of events and to safeguard other legitimate interests (Art. 6 para. 1 lit. f GDPR);
  • it is required or permitted by law on the basis of our mandate or our position under the law of the EEA or a member state (Art. 6 para. 1 lit. c GDPR) or is necessary to protect your vital interests or those of other natural persons (Art. 6 para. 1 lit. d GDPR);
  • you have consented separately to the processing (Art. 6 para. 1 lit. a and Art. 9 para. 2 lit. a GDPR).

Please note that we generally process your data for as long as required by our processing purposes (see C.), the statutory retention periods and our legitimate interests, in particular for documentation and evidence purposes, or if storage is technically necessary (e.g. in the case of backups or document management systems). If there are no legal or contractual obligations or technical reasons to the contrary, we generally delete or anonymize your data after the storage or processing period has expired as part of our usual processes and in accordance with our retention policy.

If you do not provide certain personal data, this may mean that it is not possible to provide the associated services or conclude a contract. We always indicate where personal data requested by us is mandatory.

The in Bst. The right to object to the processing of your data as set out in Section I applies in particular to data processing for the purpose of direct marketing.
